The School Act Section 36 requires that a vacancy in the membership of the Board of School Trustees (the “Board”) be filled in the following manner: 

  1. the Board shall, within 30 days, notify the City Council of the vacancy; 
  2. the City Council shall appoint a chief election officer within 30 days after being notified; 
  3. the chief election officer must set a general voting day for the trustee election that must be on a Saturday no later than 80 days after the date the chief election officer was appointed. 

The trustee elected to fill a vacant seat shall hold office only for the remainder of the term for which his/her predecessor was elected and until his/her successor takes office. 

If a vacancy occurs after January 0l in the last year of a trustee's term, the Board may decide to hold the vacancy open until the next annual election, as long as at least three (3) trustees continue to hold office.  

Unexpired Terms of Board Officers (By-law of the Board) 

In the event that the Chairperson should vacate his/her office during his/her term or cease to be a trustee, the Board shall elect a Chairperson in the manner prescribed in Board By-law No. 1, Section I, subsection 3 and 4. 

In the event that the Vice-Chairperson should vacate his/her office during his/her term or cease to be a trustee, the Board shall appoint a Vice-Chairperson to serve for the remainder of the term in the manner prescribed in Board By-law No. 1, Section I, subsection 4.
