WORKERS' COMPENSATION BOARD :  PROCEDURE FOR REPORTING INJURIES

Introduction:

The timelines to report an employee injury or occurrence of occupational disease to the Workers’ Compensation Board (WCB) are stringently enforced.  A report must be sent to WCB within three (3) days of the employee report.  When information is not received within seven (7) days, the WCB may adjudicate the employee’s claim and where the claim is allowed may levy and collect from the the Board of School Trustees (the “Board”),  the costs so paid out.  This is in addition to the annual WCB assessments paid by the Board.

Except in the case of a motor vehicle accident on a public road, every employer must  immediately initiate an investigation into the cause of every accident that requires medical treatment or has potential for causing serious injury.  Completed reports must be sent to the WCB.

Responsibilities:

The following regulations must be observed by all Board employees.

Responsibility of Employee to Report (Section 53 of the WCB Act)

In every case of an injury or disabling occupational disease to an employee that will or is likely to result in medical treatment, inability to continue to exercise the normal work duties on the day subsequent to the injury or disease, breakage of an artificial appliance, eye glasses, dentures or hearing aid, the employee shall, as soon as is practicable, inform the Board by giving information of the injury or disease.

The information shall include the name of the employee, the time and place of the occurrence, and the nature and cause of the injury or disease.

The employee shall, when fit to do so, provide particulars of the injury or disease on Workers’ Compensation Board (WCB) form 6A, “Worker’s Report of Injury or Occupational Disease to Employer”.  The forms are available from first-aid attendance and the Health and Safety Supervisor.

Responsibility of the Board (Administrator/Supervisor) to Report (Section 54 of the WCB Act)

Every supervisor or school administrator who receives information of an employee injury or occupational disease must report to the Health and Safety Supervisor as soon as possible.  When a WCB form 6A has been completed by the employee or a WCB form 7A, “First Aid Report”, by the first aid attendant, copies will be sent by facsimile transmission to the Health and Safety Supervisor.  When this is not possible, the information must be provided by telephone.

The Health and Safety Supervisor will liaise with the Payroll Division to complete the WCB form 7, “Employer’s Report of Injury or Occupational Disease”, within three (3) days of the employee’s report having been submitted and send all information to the WCB.

Responsibility of the Board (Administrator/Supervisor) to Investigate (Section 71 of WCB Act; Section 6 of WCB IH&S Regulations)

When a supervisor or school administrator receives information of an employee injury that resulted in medical treatment, disablement after the day the incident occurred or has potential for serious injury, Board form REP-PP-087, “Accident/Incident Report”, must be completed. 

The report is to be completed by an employee representing the Board as an employer and a second employee representing the injured person.  The report is to be signed by the senior area/department supervisor or administrator.

The completed report will be provided to the area safety and health committee and to the Health and Safety Supervisor.  The Health and Safety Supervisor will provide a copy to the WCB.
